General conditions of sale

1. Preamble

These General Terms and Conditions of Sale (GTC) govern all sales concluded between, on the one hand, MySafee Cosmetics, a sole proprietorship registered with the Paris Trade and Companies Register under SIRET number 95309777100026, whose head office is located in Paris (hereinafter referred to as “the Seller”), and on the other hand, any natural or legal person wishing to make a purchase via the website https://mysafee.fr (hereinafter referred to as “the Customer”).

These T&Cs are subject to change, and any new version will be applicable from the time it is posted online on the site.

2. Purpose

The purpose of these General Terms and Conditions is to define the terms of distance selling between the Seller and the Customer, from ordering to payment, including delivery and associated services.

3. Products

The products offered for sale are those that appear on the site https://mysafee.fr. Each product is accompanied by a detailed description, and the photographs are as faithful as possible but cannot ensure a perfect similarity with the product offered, particularly with regard to colors, due to the technical limitations of photographs and screens.

4. Rates

The prices displayed on the site are indicated in euros (€) including all taxes (TTC), taking into account the VAT applicable on the day of the order. The Seller reserves the right to modify its prices at any time, it being understood, however, that the price appearing on the site on the day of the order will be the only one applicable to the Customer. The prices indicated do not include delivery costs, invoiced in addition to the price of the products purchased.

5. Order

The Customer places an order on the website https://mysafee.fr. To purchase one or more items, he/she must follow the online ordering process and validate the payment. Confirmation of the order entails acceptance of these General Terms and Conditions, acknowledgement of having read them and waiver of the right to rely on his/her own conditions of purchase or other conditions. All data provided and the recorded confirmation will constitute proof of the transaction.

6. Payment

The price is due upon ordering. Payments will be made by credit card or any other means offered on the site https://mysafee.fr. Transactions are secured by an approved payment provider. Payment information is not stored by the Seller. MySafee Cosmetics will not be responsible for any omission, error or irregularity occurring during payment processing.

7. Delivery

Deliveries are made to the address indicated by the Customer when ordering. Delivery times are specified on the site and may vary depending on the destination and logistical conditions. In the event of a delay in delivery, the Customer will be informed by e-mail.

In accordance with legal provisions, in the event of a delivery delay of more than 30 days, the Customer has the possibility to cancel his order under the terms and conditions defined in Article L.216-2 of the Consumer Code. Delivery costs will be added to the order total and specified before the final validation of the order.

8. Right of withdrawal

In accordance with Article L.221-18 of the Consumer Code, the Customer has a period of 14 days from receipt of his order to exercise his right of withdrawal without having to provide reasons or pay penalties.

Returns must be made in their original condition and complete (packaging, accessories, instructions, etc.), allowing them to be resold as new. Return costs are the responsibility of the Customer. Reimbursement will be made within 14 days of receipt of the returned products.

9. Guarantees

All products supplied by the Seller benefit from the legal guarantee of conformity provided for in Articles L.217-4 et seq. of the Consumer Code and the guarantee against hidden defects provided for in Articles 1641 et seq. of the Civil Code. In the event of non-conformity of a product sold, it may be returned, exchanged or refunded under the conditions provided for by the legislation in force.

10. Liability

The Seller, in the online sales process, is only bound by an obligation of means. Its liability cannot be incurred for damage resulting from the use of the Internet network such as loss of data, intrusion, viruses, service interruption, or other involuntary problems.

11. Intellectual Property

All elements of the site https://mysafee.fr, as well as all creative, visual and sound elements, are protected by intellectual property rights, including copyright, trademark law and design law. These elements include, but are not limited to:

• The graphic chain (including design, fonts, colors and layout),

• The MySafee Cosmetics logo, in all its versions and variations,

• The website https://mysafee.fr, including its structure, content and visual elements,

• The packaging and packaging of the products, including the design, illustrations, typography and any other associated graphic elements,

• Promotional visuals, photographs, videos, and other creative content created for MySafee Cosmetics.

All these elements are the exclusive property of MySafee Cosmetics. Any reproduction, representation, modification, publication, transmission, distortion, total or partial of one of these elements, by any process whatsoever, and on any medium whatsoever, is strictly prohibited, except with the prior written authorization of MySafee Cosmetics.

This specifically includes, but is not limited to:

• The reproduction of the MySafee Cosmetics logo or its variants (colors, sizes, shapes, etc.) on any medium (web, print, product, advertising, etc.) without the prior consent of MySafee Cosmetics,

• The reproduction of the website design, its structure, as well as any part of its visual or textual content on another site or digital medium,

• The reproduction of packaging elements, including the designs of pots, bottles, and boxes, as well as their specific variations for each MySafee Cosmetics product,

• The use of product visuals (photos, videos, staging elements) in advertising campaigns or any other form of commercial communication, without express authorization.

Any unauthorized use of the visual and creative elements mentioned above may result in civil and/or criminal liability of the perpetrator of the infringement. MySafee Cosmetics reserves the right to take legal action in the event of infringement of its intellectual property rights.

The Customer undertakes to respect these intellectual property rights and not to use the protected elements without prior written authorization from MySafee Cosmetics. This respect also extends to any commercial or promotional use, even partial, of the visuals, logos or other creations of MySafee Cosmetics.

12. Vouchers and Promotional Codes

MySafee Cosmetics may offer vouchers or promotional codes offering specific discounts or benefits on its products. The conditions for using these vouchers or codes are as follows:

• Validity: Each voucher or promotional code is valid for a limited period, specified when it is communicated. After this period, they can no longer be used.

• Usage: Vouchers and promotional codes can only be used once per person and cannot be combined with other current offers or promotions, unless otherwise indicated.

• Conditions: Some vouchers or codes may be subject to specific conditions, such as a minimum purchase amount or a specific selection of products. These conditions will be clearly specified when the voucher or code is communicated.

• Non-transferability: Vouchers and promotional codes are nominative and cannot be transferred to third parties without the prior consent of MySafee Cosmetics.

• Fraudulent Use: MySafee Cosmetics reserves the right to refuse the application of a voucher or promotional code in the event of suspected fraudulent use or use that does not comply with these conditions.

13. Final Provisions

These T&Cs constitute the entire agreement between the parties. If any provision of these T&Cs is found to be invalid or unenforceable by a competent court, the remaining provisions will remain in effect.
